Information is provided in article relatively use of lands along the water objects, provided by executive committee of Sudaksky city council.
The department of the ground relations of executive committee of Sudaksky city council informs the population as follows.
According to Art. 4 of the Water code of Ukraine and 58 Land codes of Ukraine (further – ZKU) belong to lands of water fund of the earth, busy;
– by seas, the rivers, lakes, reservoirs, other water objects, bogs, and also the islands, not taken with the woods;
– coastal protective strips along the seas, the rivers and round reservoirs, except the lands occupied with the woods;
– hydraulic engineering, other water economic constructions and channels, and also the lands allocated under strips of branch for them;
– shores of waterways.
For creation of a favorable mode of water objects, preventions of their contamination, pollution and an ischerpyvaniye, destruction of okolovodny plants and animals, and also reduction of fluctuations of a current along the seas, round lakes, reservoirs and other reservoirs are established the water conservation zones which sizes are determined by land management projects.
According to ZKU Art. 60 along the rivers, the seas and round lakes, reservoirs and other objects with a view of protection of superficial water objects from pollution, a contamination and preservations of their vodnost in borders of water conservation zones are allocated the land lots under coastal protective strips. H. 2 Art. 60 of ZKU, determine by Art. 88 of the Water code of Ukraine the sizes of coastal protective strips by coast of the rivers and round reservoirs lengthways ureza waters. So, for example, for the small rivers, streams and streamlets, and also stavkov in the area not less <st1:metricconverter ProductID = the 3rd hectare w:st = on> the 3rd hectare </st1:metricconverter> are established protective strips in width <to st1:metricconverter ProductID = 25 meters by w:st = on> 25 meters </st1:metricconverter>. For average small rivers, reservoirs on them, reservoirs, and also stavkov in the area from above <st1:metricconverter ProductID = 3 hectares w:st = on> 3 hectares </st1:metricconverter> – <st1:metricconverter ProductID = 50 m w:st = on> 50 m </st1:metricconverter>.
If the steepness of a slope exceeds 3 degrees, the minimum width of a coastal protective strip doubles. In borders of existing settlements the coastal protective strip is established taking into account specific conditions which already developed.
In the territory of. The pike perch proceeds river Taraktash and the river Karagach (inflow of river Taraktash) which run into the Black Sea. In 1982 the water conservation zone of river Taraktash (before river was established. A pike perch) extent <st1:metricconverter ProductID = 22 km w:st = on> 22 km </st1:metricconverter>, width <st1:metricconverter ProductID = 10 meters w:st = on> 10 meters </st1:metricconverter> on lands of agricultural purpose.
Coastal protective strips are the nature protection territory with a mode of limited economic activity. Art. 61 of ZKU and Art. 87,89 of the Water code of Ukraine in coastal protective strips along the rivers, round reservoirs and on islands are forbidden:
– a raspashka of lands (except soil preparation for a zaluzheniye and afforestation), and also gardening and truck farming;
– storage and application of pesticides and fertilizers;
– arrangement of summer camps for cattle;
– construction of any constructions (except hydraulic engineering, hydrometric and linear), including recreation facilities, dachas, garages and parking of cars;
- device of dumps of garbage, navozoxranilishh, stores of a liquid and firm waste
productions, cemeteries, skotomogilnik, water filtrations, etc.;
– sink and service of vehicles and equipment;
– dumping of crude sewage, land relief use (beams, pits, etc.), and also streamlets.
Also there are restrictions of economic activity and in coastal protective strips along the seas, sea gulfs, estuaries and on islands in internal sea waters (Art. 62 of ZKU, Art. 90 of the Water code of Ukraine).
Objects which are in a coastal protective strip, can be maintained, if its mode thus isn’t broken. Unsuitable constructions for operation, and also what don’t correspond to the established modes of managing, are subject to carrying out from coastal protective strips.
Control over creation of water conservation zones and coastal protective strips, observance of a mode of use of their territories is carried out by executive committees of local councils and state authorities of protection of surrounding environment.
According to Art. 19 requirements, 20 Water codes of Ukraine the state control of use and protection of waters and renewal of water resources is carried out by Cabinet council of Ukraine, state authorities of protection of surrounding environment, other specially authorized state authorities, and also public inspectors according to their powers.
