In this article the list of laws on receiving the land lot in rent is stated.
Development of the market of the earth in Ukraine is defined by the Presidential decree of Ukraine in 1995 (No. 608/95 from 12.06.1995) About privatization and rent of the land lots not agricultural purpose for entrepreneurial activity implementation. Process of sale of the land lots of the state or municipal property after an exit of presidential decrees of Ukraine from 19.01.1999 of No. 32 About sale of the land lots of nonagricultural appointment and from 04.02.2000 of No. 168 About measures for development and regulation of the market of lands of settlements, other lands of nonagricultural appointment became more active.
With coming into effect of the Land code of Ukraine (No. 2768-Sh from 25.10.200G), entered validity since January 01, 2002, sale of the land lots of the state and municipal property is settled legislatively by articles 127 – 130 and Code articles 134-138.
Since January 1, 2008 the second section of the Law of Ukraine About the government budget of Ukraine for 2008 and about modification of some acts of Ukraine by which changes are made to the Land code of the country entered validity.
The above-stated Law made changes and to the current Land code of Ukraine. So, it agrees p.1 Art. 124 of this code (with the brought changes) buying of rent the land lots which are in the state or municipal property, is carried out only at auctions, except the land lots on which objects of fast estate which are in a property of citizens and legal entities are located and in which there are no actions (parts, shares) which belong to the state.
Also carrying out auctions concerning sites which (structures on which) rent state-financed organizations, museums, the enterprises and public organizations in the culture and art sphere (including national creative spilka and their members (under creative workshops) isn’t allowed.
Thus, with coming into effect of the Law of Ukraine About the government budget of Ukraine for 2008 and about modification of some acts of Ukraine to receive in rent free from building the land lot probably only on the competitive beginnings.
