plant growing productions
1. This Order defines use mechanism in 2007 of the means provided in the government budget () behind the program "The budgetary cattle-breeding grant and the state support of production of plant growing" (further – budgetary funds).
The main manager of budgetary funds is Minagropolitiki.
2. Budgetary funds go to agricultural enterprises on the basis of data on the area on which there ascended winter and summer crops to grain, flax-dolgunets and hemp on trust, in such sizes:
1) on winter crops:
wheat, tritikale and a rye – 100 hryvnias on 1gektar crops, barley – 55, a rape – 50 hryvnias on 1gektar crops;
2) on summer cultures:
wheat and tritikale – 100 hryvnias on 1 hectare of crops, peas – 80, a soya not below the first reproduction – 80, a soya not below the third reproduction – 50, a buckwheat – 80, millet – 80, a rape – 50, rice – 220 hryvnias on 1gektar crops;
flax-dolgunets and hemp on trust – 640 hryvnias on 1 hectare
crops.
3. Minagropolitiki carries out in coordination with the Ministry of Finance distribution of budgetary funds between the Ministry of an agrarian policy of the Autonomous Republic Crimea, head departments of agroindustrial development regional and management of the industry and agroindustrial development Sevastopol city the state administrations proportionally to the areas of crops of the crops defined in point 2 of this Order.
The ministry of an agrarian policy of the Autonomous Republic Crimea and head departments of agroindustrial development of the regional state administrations within three working days after receipt from Minagropolitika of the relevant information carry out distribution of budgetary funds between areas in proportion to the specified areas about what send the message to managements of agroindustrial development of the district state administrations to three-day term.
Managements of agroindustrial development of the district state administrations within three working days after receipt of the message on distribution of budgetary funds place in mass media the announcement with the indication of the list of the documents necessary for obtaining of budgetary funds, term and conditions of their representation.
4. After the adoption of distribution of budgetary funds of Minagropolitika within three working days submits State
to treasury the register of changes of distribution of indicators of the consolidated estimates and allocation plans in a cut of regions in proportion to the approved
to distribution of budgetary funds.
The ministry of an agrarian policy of the Autonomous Republic Crimea and head departments of agroindustrial development of the regional state administrations within three working days after receipt from Minagropolitika messages on distribution of budgetary funds approve estimates and allocation plans in a cut of areas and transfer them to appropriate bodies of the State treasury.
Budgetary funds are distributed by Minagropolitiki, the Ministry of an agrarian policy of the Autonomous Republic Crimea, head departments of agroindustrial development regional, managements of agroindustrial development regional and management of the industry and agroindustrial development Sevastopol city the state administrations proportionally to the sums approved in plans of appropriation for the corresponding year.
5. For definition of the list of agricultural enterprises of budgetary funds having the right to receiving, managements of agroindustrial development of the district state administrations the chairman of Homestead Association, the representative of council of agricultural enterprises (further – the commission) create the commission into which structure enter the head of department (commission chairman), on one representative of the appropriate financial body, bodies of the public control and auditing service, national tax service and the state statistics, the state seed inspection and the state station of protection of plants.
The relevant commission is created by management of the industry and agroindustrial development of the Sevastopol gorgosadministratsiya.
6. The demand for obtaining budgetary funds agricultural enterprises – legal entities irrespective of an organizational and legal form, form of ownership and the management sphere, including educational and educational and research farms of agrarian higher educational institutions, professional educational institutions, scientific and research establishments, selection and research and state sortoispytatelny stations which sowed winter and summer crops on grain, have the right to submit to the commission flax-dolgunets and hemp on trust, except the budgetary establishments and the enterprises which are recognized as bankrupts or against which action on bankruptcy is brought and which have delayed more than half a year debt before state and local budgets, the Pension fund of Ukraine (further – agricultural enterprises).
The demand moves in the commission on winter crops till April 1, on summer cultures – till July 1.
To the demand are applied:
1) on winter crops – the report on a course of harvesting and carrying out other field works on _______ 200_ g (7-sg form N) (va280202-06), spetsilizirovanny accounting forms of the primary accounting of N 118 "The act of an ispolzovniya of mineral, organic and bacterial fertilizers, yadoximikatov both herbicides" and N 119 "The act of an expense of seeds and a landing material", and also defined DSTU 2240-93 documents on crops by seeds not below the third production;
2) on summer cultures – the final report on sowing results on the crop’s eve 200 __ (4-sg form N) (vb280202-06), specialized accounting forms of the primary accounting of N 118 "The act of use of mineral, organic and bacterial fertilizers, otrutoximikativ and herbicides" (and for a soya – the act of use of biological products on the basis of azotof_ksuyuchy microorganisms for preseeding processing of seeds) and N 119 "The act of expenses of seeds and a sadivny material", and also certain DSTU 2240-93 documents on crops by seeds not below the third reproduction;
3) the copies of documents certified in accordance with the established procedure, namely:
certificates of inclusion in the Uniform state register of the enterprises and the organizations of Ukraine;
the report on financial results for previous year;
the documents confirming an ownership right or usings the land lot;
references of appropriate bodies of national tax service and Pension fund of Ukraine on lack (existence) of debt on tax to obligations and payments in Pension to fund of Ukraine:
4) the written obligation of agricultural enterprise to return in a month in the budget the received budgetary funds in case of establishment by supervisory authorities of the fact of their illegal receiving and/or no-purpose use (in case of not return of means to the specified term the fine at a rate of 120 annual interest rates of discount rate of National bank per every day of delay is charged. Thus in case of identification of the specified facts to such agricultural enterprise providing any state support throughout current and three stops
next budgetary periods.
Lack of one of the documents defined by this point, deprives of the applicant of the right to budgetary funds.
7. The commission considers presented according to point 6 of this Order documents, establishes reliability of the data provided in them, surveys crops, draws up the statement based on the results of testing and makes the decision concerning inclusion (non-inclusion) of the applicant in the register of agricultural enterprises which have the right to obtaining budgetary funds (further – the register of agricultural enterprises). Forms of acts and registers of agricultural enterprises are approved by Minagropolitiki.
In default in allocation of budgetary funds the commission in three-day term after decision-making gives out (sends) to agricultural enterprise the reasonable answer.
The register of agricultural enterprises together with the presented documents remains in management of agroindustrial development regional, management of the industry and agroindustrial development Sevastopol city the state administrations for three years.
8. Managements of agroindustrial development regional, management of the industry and agroindustrial development Sevastopol city the state administrations on the basis of the documents presented by agricultural enterprises, send to appropriate bodies of the State treasury registers of agricultural enterprises and payment powers of attorney for transfer of budgetary funds to current accounts of agricultural enterprises in establishments of banks.
Operations with budgetary funds are carried out according to Order of service of the government budget on expenses (), the approved State treasury.
9. Managements of agroindustrial development of the district state administrations monthly to the 5th of the next period submit to the Ministry of an agrarian policy of the Autonomous Republic Crimea, head departments of agroindustrial development of the regional state administrations certified copies of registers of agricultural enterprises on the basis of which budgetary funds are transferred.
The ministry of an agrarian policy of the Autonomous Republic Crimea, head departments of agroindustrial development regional, Sevastopol city the state administrations on the basis of registers of agricultural enterprises prepare management of the industry and agroindustrial development and represent Minagropolitiki:
quarterly to the 15th day of the next month information on number of agricultural enterprises by which the right to budgetary funds, and the sum of budgetary funds in a form defined by Minagropolitiki, for generalization and the direction to the Ministry of Finance to the 20th day of the specified month is confirmed;
after the expiration of fiscal year the report on use of budgetary funds on a form defined by Minagropolitiki, for generalization and the direction to the Ministry of Finance till February 1 of the next year.
