I want to buy the land lot. The seller provided a state act copy from 2004 in which there is no cadastral number. The Village Soviet issued the reference that cadastral number on this site didn’t stand out. Whether it is lawful? Whether will be then at us problems if the notary certifies the contract with such reference (about not assignment to this site of cadastral number)?

According to item 8 of the Temporary order of maintaining the state register of lands (it is approved as Goskomzem Ukrainy # 174′s order from 02.07.2003), registration (cadastral) number is appropriated to the state act on an ownership right on the land lot, to the state act on the right of continuous using by the land lot, to the earth lease contract at the moment of implementation of its state registration.

Registration number is obligatory for the state acts of an ownership right on the land lot, received after August 15, 2003 (from the date of official publication of the Temporary order). Therefore, if cadastral number of a site in the state act isn’t specified, that, according to item 10.4 of the Temporary order it is necessary to submit the application for elimination of a technical mistake to territorial body of ground resources (the state land cadastre). The statement should be considered in 10-day term.

It is necessary to note also that in a number of regions and after 2004 issue of the state acts of an old sample, the Ministry approved nowadays by become invalid resolution from March 24, 1999 in which the corresponding column was absent proceeded. In that case, assignment to a site of cadastral number occurs after the conclusion of the contract of purchase and sale of the land lot at renewal of the state act of an ownership right on a site addressed to (name) of the new owner.
