1. General provisions
1.1. The real Order and conditions determine proceduru competitive selection of farms otnosiyotelno granting financial support by it on a returnable basis, according to Order of an ispolyyozovaniye of the means provided in the government budget for providing of support to farms, the approved resolution of Cabinet council of Ukraine from August 25, 2004 of No. 1102.
1.2. The purpose of carrying out competition is opredeleyony the list of farms, which predostavlyaetsya financial support on returnable osnove at the expense of the means provided in the gosudaryostvenny budget.
2. Organization and carrying out competition
2.1. For the organization of the work connected with provedeyoniy competition, Ukrainskoyogo’s regional offices of the state fund of support of farms (further – regional offices of Fund) create the commissions, headed them rukovoditelyami, in number of eight people. The provision on a koyomissiya and its structure is approved by head Fonda in coordination with Minagropolitiki.
2.2. Information on carrying out competition will be published in printing mass media after the statement of structure of the commission.
2.3. The message on carrying out competition should soderzhat date of commission session, the requirement concerning participation in is mute, a site of regionalyyony office of Fund on which documents, phone for references are accepted.
3. Requirements to participants, their participation in competition
3.1. Demands acceptance for participation in competition and the documents enclosed to them, begins from the date of the publication of an information message about its carrying out.
3.2. For participation in competition a farm (further – the applicant) files the following documents on komisyosiya consideration:
• the demand for receiving financial support on a returnable basis in duplicate;
• copy of the Charter of a farm;
• a copy of the reference on inclusion in the Uniform gosudarstvenyony register of the enterprises and the organizations of Ukraine;
• copies of the documents confirming the right of a sobyostvennost or using the land lot;
• certificate of bank details of a farmer hoyozyaystvo;
• the reference issued by appropriate body of goyosudarstvenny tax service and the Pension fund of Ukraine, concerning lack (existence) of debt on the tax obligations and payments in the Pension fund of Ukraine;
• balance and the report on financial results of hozyaystvenyony activity of a farm for the posleyodny reporting period in the established form;
• the business plan with technical and economic obosnovaniyoy expediency of allocation of a financial podyoderzhka to a farm and with the instruction grafika return of means;
• the farm offer concerning a way of ensuring implementation of the obligation.
Copies of the presented documents should be zavereny in the order established by the legislation.
3.3. The documents presented on competition proveryayutsya the secretary of the commission also are registered in poryadke their receipts in a log-book of farmer hoyozyaystvo. One copy of the demand with registration number comes back to the applicant (appendix).
3.4. The documents presented not in full aren’t registered and come back to the applicant with the indication of the reasons of return. Registration or return of documents is made in day of their receipt.
3.5. In case of identification of unreliable information the secretary of the commission doesn’t register documents and vozvrashhaet to the applicant with the indication of the reason of return.
3.6. Commission session is carried out in process of a postupyoleniye of means in the presence of applications for participation in competition.
3.7. The main criteria during definition of winners of competition are:
• providing guarantees of return of means, poluchenyony on a returnable basis;
• efficiency and payback investment innovacionnyx projects;
• creation of additional workplaces in the rural zone;
• specialization on production scarce in regione separate types of agricultural production.
3.8. In default in providing financial support to a farm according to the commission decision regional office of Fund predostavlyaet in three-day term the reasonable written answer with the indication of causes of failure.
3.9. In case of making decision on providing financial support the commission:
• represents the relevant documents to regioyonalny office of Fund;
• issues to a farm the certificate of a predosyotavleniye of financial support on competitive principles on a returnable basis on the basis of which the regional office of fund signs with it the contract on granting a financial podyoderzhka on a returnable basis about what the otyometka in a log-book of farms becomes.
3.10. The decision of the commission is accepted by the majority of her members present at meeting. In case of equal quantity of voices the voice predsedatelyyostvuyushchy at meeting is solving.
3.11. The decision of the commission is made out by the protocol, kotoyory all present members of the commission sign.
