Opinions on the Law of Ukraine About meat and meat products heads of branch associations, producers, pererabotchik of meat production, suppliers of food components and the Minister of an agrarian policy of Ukraine A.Baranivskogo are presented.

Participants of the Ukrainian market of meat ask the President of Ukraine Victor Yushchenko vetirovat the Law No. 3489-IV "About meat and meat products" in the edition accepted by the Verkhovna Rada on February 23. About it it is told in the address signed by heads of branch associations, producers, pererabotchik, distributors of meat production, suppliers of food components and the equipment for the meat industry.
According to the experts, the passed law can essentially complicate work of meat branch and bears threat for national economy. In the address it is emphasized that representatives of branch made the offers in the bill, but agrarian committee of the Verkhovna Rada which prepared the project for the second reading, these offers didn’t consider. "The specified law should order branch work, but essential discrepancies of technical and technological character, a contradiction and discrepancy of the document to norms of the international legislative practice nullify even those provisions of the document which could promote development of meat branch" – participants of the market argue.
They specify that the ban and permission to use in meat products of certain grades of these or those components is establishment of the corresponding standards, and it doesn’t belong to powers of the Verkhovna Rada. Certification of subjects of managing, including the individuals, provided by the law, won’t be coordinated with standards of the Economic code of Ukraine (speech can go only about certification of productions).
Besides, contradicts the current legislation and introduction of the mechanism of definition of minimum prices of purchase of agricultural animals and a bird (Law Art. 14 "About meat and meat products") that "indirectly imposes a ban on any intermediary activity on realization of meat and meat products".
Art. 15 of the law provides state control which four state authorities (sanepidsluzhby carry out in parallel, Ukrmetrteststandart’s Gosnadzor, inspectors of managements on protection of the rights of consumers and state inspectors of managements of veterinary medicine). "It, in turn, can cause a tenizatsiya of the market of meat and a myasoproduktsiya" – experts consider.
Application of penalties to subjects of managing for violation of requirements of this law without determination of their size, conditions and an order of their application won’t be coordinated with standards of the Economic code of Ukraine, told in the address.
As provisions of the Law "About meat and meat products" are conceptually constructed on the principles contradicting the constitutional norms and other laws of Ukraine, participants of the market ask the President of Ukraine to use the veto concerning this law.
Reference. According to the Law "About meat and meat products", all suppliers and pererabotchik of meat are subject to certification which is led time in 5 years. Rigid requirements to use of additives by production of meat products of various grades are established, production realization in the spontaneous markets, etc. is forbidden. It is not authorized to appropriate to new types of products well-known names (type "Doctor’s", "Dairy"). For violation of provisions of the law participants of the market can be fined (the sizes of penalties thus aren’t specified).
In turn, the Ministry of an agrarian policy of Ukraine addressed to the President of Ukraine with a request to sign the above-named law adopted by parliament on February 23, 2006. It was declared by head MINAP Alexander Baranovsky at press conference on March 20.
"We don’t know that we eat. Carry any muck from abroad … It is (law) correct, it providing safety of our citizens" – the minister is convinced.
According to him, support adoption of this law the large processing enterprises, and against small producers of meat production act.
"I communicated with large pererabotchik of meat – they ask, that we passed this law quicker, and those who works on sheds and on cellars, them, of course, such law is unprofitable" – A.Baranovsky told.
As it was reported, the Verkhovna Rada of Ukraine passed on February 23 the law on meat and the meat products which purpose is creation of conditions for production and providing the population with meat and meat products of the guaranteed quality and safety.
According to the document, in Ukraine use in meat products of the premium of meat weight, albuminous stabilizers, a pork skin, food starch, a vegetative flour, products from a soya, and also food additives (except nitrate of sodium, ascorbic acid, askorbinata sodium, phosphates) and mixes of spices which structure includes food additives is forbidden. Thus to use all these components it is authorized in meat products I grades at a rate of no more than 30 % of lump of raw materials, II grades – 40 %, III – 50 %.
The law assumes obligatory certification of the enterprises which are carrying out delivery of raw materials, its processing and production of meat products, times in 5 years. Realization of meat, meat raw materials and meat products is forbidden to thus not certified enterprises.
