In given article the Sudaksky city advice informs citizens and the legal entities interested in buying of rent on the land lots of a various designated purpose, on changes in the ground legislation of Ukraine.
The department of the ground relations of executive committee of Sudaksky city council informs citizens and the legal entities interested in buying of rent on the land lots of a various designated purpose, on changes in the ground legislation of Ukraine.
On October 14, 2008 the Law of Ukraine About modification of some acts of Ukraine about assistance to construction from 16.09.2008 of No. 509-VI by which changes, except other, are made to the Land code of Ukraine, the Law of Ukraine About a ground lease, concerning buying of rent the land lots being in the state or municipal property came into force.
According to h. 2 Art. 124 of the Land code of Ukraine transfer to rent of the land lots of the state or municipal property are carried out by results of carrying out the ground auction (auctions), except the cases established by h. 2 Art. 134 of the Land code of Ukraine according to which the land lots of the state or municipal property or the right to them in a case aren’t subject to sale on the competitive beginnings (the ground auction):
– arrangements on the land lots of objects of fast estate which are in a property of citizens, legal entities; in which there are no actions (parts, shares), belonging to the state, except cases of refusal of the owner of the fast estate located on the land lot from its repayment or the conclusion of the lease contract;
– uses of the land lots for using a subsoil and special water use according to the received special permissions (licenses);
– use by the religious organizations, which legalizirovany in Ukraine, the land lots under cult structures;
– stay in using of the land lots or the structures of the enterprises located on them, establishments and the organizations which treat the state or municipal property, the enterprises and public organizations in the culture and art sphere (including national creative workshops);
– placement of the representations of foreign states diplomatic and equated to them and the international organizations agrees with international treaties of Ukraine;
– construction and service of linear objects of transport and power infrastructure (roads, gas pipelines, water supply systems, power lines, airports, oil and gas terminals, power plants and others);
– carrying out complex reconstruction of quarters (residential districts) of old dwelling stock according to the law;
– construction of social and affordable housing if competition on its construction is carried already out.
Besides, according to h. 3 Art. 134 the ground auction aren’t carried out at allocation (transfer) of the land lots to citizens in the cases provided by articles 34,36 and 121 of the Land code of Ukraine.
The order of sale of the land lots or the right to them on the competitive beginnings is reworded as follows in chapter 21 of the Land code of Ukraine.
It would be desirable to note that point 1 of the section X of Transitional provisions of the Land code of Ukraine is added with the paragraph of the third following contents:
In case of acceptance by appropriate body of the decision on coordination of the location of object or about delivery of permission to development of the project of branch of the land lot till January 1, 2008 transfer to rent of such land lots from lands of the state or municipal property is carried out without carrying out the ground auction (auctions).
