Provisions of the Law of Ukraine from 21.02.06 of No. 3448-IV are considered.
The law No. 3448-Ivumenshen the size of the salary paid by nature. Now it doesn’t exceed 30 % of the sum of the salary added in a month (before was no more than 50 %).
Let’s remind that according to the Law About compensation * the salary can partially be paid (Art. 23) by nature, if:
• such payment is provided by the collective agreement;
• at cost it is equivalent to compensation in terms of money and is desirable for workers;
• the prices for production given out on account of a salary don’t exceed its prime cost;
• the list of given-out production (goods) isn’t forbidden by the Resolution No. 244 **.
These requirements concern only naturoplaty, that is compensation in a natural form which is charged and stands out to the worker for the amount of works executed by it and doesn’t provide compensation by this worker of cost of production given out to it (the Letter No. 1249 ***).
For example, according to situation on compensation the enterprise charges and gives out to the combine operator 3 tsentyoner of grain for performance of seasonal performance standard by it on harvesting of the grain. Production is in that case estimated in terms of money and joins in compensation fund.
However, we will notice, the above-stated restrictions can be avoided if to arrive thus: nachislit to the worker a salary in a monetary form, and then, according to his statement, on account of the added salary to give out it production (to perform work to render services). And it will be any more work wages in kind, and prodazha production on account of the added salary. For the agrarian and industrial complexes enterprises such operations predusmotreny the Industry agreement **** (item 5.34).
The law of Ukraine from 21.02.06 of No. 3448-IV About modification of article 23 of the Law of Ukraine About compensation came into force since 10.03.06.
