In article to be said that the Law of Ukraine About the Government budget of Ukraine for 2008 and about modification of some acts of Ukraine provided changes in the Law of Ukraine About the status and social protection of the citizens who were injured owing to Chernobyl accident. In particular, the order of definition of additional pension on age for a damage caused to health, the faces carried to 1, 2, 3, 4 categories, monthly compensation to families for loss of the supporter owing to Chernobyl accident, the minimum sizes of disability pensions to the faces carried to 1 category which are defined from 01.01.08 as the percentage to a subsistence minimum for the persons which have lost work capacity changes.
The law of Ukraine About the Government budget of Ukraine for 2008 and about modification of some acts of Ukraine provided changes in the Law of Ukraine About the status and social protection of the citizens who were injured owing to Chernobyl accident.
In particular, the order of definition of additional pension on age for a damage caused to health, the faces carried to 1, 2, 3, 4 categories, monthly compensation to families for loss of the supporter owing to Chernobyl accident, the minimum sizes of disability pensions to the faces carried to 1 category which are defined from 01.01.08 as the percentage to a subsistence minimum for the persons which have lost work capacity changes.
Article 55 of the Law of Ukraine About the Government budget of Ukraine for 2008 and about modification of some acts of Ukraine provided the next size of a subsistence minimum for 2008 for persons who lost work capacity: since January 1 – 470 hryvnias, since April 1 – 481 grivnya, since July 1 – the 482nd hryvnia, since October 1 – 498 hryvnias.
To the faces carried to 1 category, the additional pension is appointed next sizes:
to disabled people of 1 group – 30 percent of a subsistence minimum for persons who lost work capacity that makes from 01.01.08 141 UAH. (470 UAH. x 30 %), from 01.04.08 – 144,30 UAH. (481 UAH. x 30 %), from 01.07.08 – 144,60 UAH. (482 UAH. x 30 %), from 01.10.08 – 149,40 UAH. (498 UAH. x 30 %);
to disabled people of 2 groups – 20 percent of a subsistence minimum for persons who lost work capacity that makes from 01.01.08 94 UAH. (470 UAH. x 20 %), from 01.04.08 – 96,20 UAH. (481 UAH. x 20 %), from 01.07.08 – 96,40 UAH. (482 UAH. x 20 %), from 01.10.08 – 99,60 UAH. (498 UAH. x 20 %);
to disabled people of 3 groups, disabled children, and also patients owing to Chernobyl accident by radiation sickness – 15 percent of a subsistence minimum for persons who lost work capacity that makes from 01.01.08 70,50 UAH. (470 UAH. x 15 %), from 01.04.08 – 72,15 UAH. (481 UAH. x 15 %, from 01.07.08 – 72,30 UAH. (482 UAH. x 15 %), from 01.10.08 – 74,70 UAH. (498 UAH. x 15 %).
To the faces carried to 2 categories, the additional pension is appointed at a rate of 15 percent of a subsistence minimum for persons who lost work capacity that from 01.01.08 makes 70,50 UAH. (470 UAH. x 15 %), from 01.04.08 – 72,15 UAH. (481 UAH. x 15 %), from 01.07.08 – 72,30 UAH. (482 UAH. x 15 %), from 01.10.08 – 74,70 UAH. (498 UAH. x15 %).
To the faces carried to 3 categories, the additional pension is appointed at a rate of 10 percent of a subsistence minimum for persons who lost work capacity that from 01.01.08 makes 47 UAH. (470 UAH. x 10 %), from 01.04.08 – 48,10 UAH. (481 UAH. x 10 %), from 01.07.08 – 48,20 UAH. (482 UAH. x 10 %), from 01.10.08 – 49,80 UAH. (498 UAH. x 10 %).
To the faces carried to 4 categories, the additional pension is appointed at a rate of 5 percent of a subsistence minimum for persons who lost work capacity that from 01.01.08 makes 23,50 UAH. (470 UAH. x 5 %), from 01.04.08 – 24,05 UAH. (481 UAH. x 5 %), from 01.07.08 – 24,10 UAH. (482 UAH. x 5 %), from 01.10.08 – 24,90 UAH. (498 UAH. x 5 %).
Monthly compensation to families for loss of the supporter owing to Chernobyl accident is appointed to each invalid member of the family who was on his expense, at a rate of 10 percent of a subsistence minimum for persons who lost work capacity that from 01.01.08 makes 47 UAH. (470 UAH. x 10 %), from 01.04.08 – 48,10 UAH. (481 UAH. x 10 %), from 01.07.08 – 48,20 UAH. (482 UAH. x 10 %), from 01.10.08 – 49,80 UAH. (498 UAH. x10 %).
The minimum sizes of pensions for disabled people at whom the causal connection is established with Chernobyl accident, make from 01.01.08:
for participants of elimination of the Chernobyl accident in 1986:
on 1 group of disability – 220 percent of a subsistence minimum for persons who lost work capacity that makes from 01.01.08 1034 UAH. (470 UAH. x 220 %), from 01.04.08 – 1058,20 UAH. (481 UAH. x 220 %), from 01.07.08 – 1060,40 UAH. (482 UAH. x 220 %), from 01.10.08 – 1095,60 UAH. (498 UAH. x 220 %);
on the 2nd group of disability – 200 percent of a subsistence minimum for persons who lost work capacity that makes from 01.01.08 940 UAH. (470 UAH. x 200 %); from 01.04.08 – 962 UAH. (481 UAH. x 200 %), from 01.07.08 – 964 UAH. (482 UAH. x 200 %), from 01.10.08 – 996 UAH. (498 UAH. x 200 %);

Pensions on the occasion of loss of the supporter are appointed to invalid members of the family of the died supporter who were on his expense (thus to children pension is appointed irrespective of, whether there were they in charge of the died supporter), in the size:
on one invalid member of the family – 50 percent of a disability pension of the died supporter;
on two and more invalid members of the family – 100 percent of pension of the died supporter defined according to article 54 of the Law of Ukraine About the status and social protection of the citizens who were injured owing to Chernobyl accident, distributed between them in equal shares.
Thus, the size of a subsistence minimum for persons who lost work capacity, is defined on the moment of payment of additional pension, monthly compensation to families for loss of the supporter owing to Chernobyl accident, pension for disabled people at whom the causal connection is established with Chernobyl accident, according to the law on the Government budget of Ukraine and can’t korregirovatsya other normative legal acts.
The part third of article 67 of the Law of Ukraine About the status and social protection of the citizens who were injured owing to Chernobyl accident is stated in the following edition:
The maximum size of the pensions defined according to this Law (taking into account extra charges, increases, additional pension, the target monetary assistance, pensions for special merits in front of Ukraine and other surcharges to the pension, established by the legislation) can’t exceed twelve minimum sizes of pension on the age, established by the paragraph the first part one of article 28 of the Law of Ukraine About obligatory the state pension insurance.
From 01.01.08 payment of increases according to article 67 of the Law of Ukraine About the status and social protection of the citizens who were injured owing to Chernobyl accident in connection with increase in a subsistence minimum stops.
However, if before pension recalculation the size of pension taking into account increase according to article 67 of the Law of Ukraine About the status and social protection of the citizens who were injured owing to Chernobyl accident byl more than the size of pension after recalculation, to such pensions is formed surcharge till the old size of pension taking into account increase according to article 67 of the Law of Ukraine About the status and social protection of the citizens who were injured owing to Chernobyl accident.
Thus, the maximum sizes of the pensions counted from 01.01.08 according to the Law of Ukraine About the status and social protection of the citizens who were injured owing to Chernobyl accident, can’t exceed:
from 01.01.08 – 5640 UAH. (470,00 x 12),
from 01.04.08-5772 UAH. (481,00 x 12),
from 01.07.08 – 5784 UAH. (482,00 x 12),
from 01.10.08 – 5976 UAH. (498,00 x 12).
