Article is devoted to changes in the ground legislation concerning sale of the right of rent on the earth through auction.

The department of the ground relations of executive committee of Sudaksky city council informs citizens and the legal entities interested in buying of rent of free from building of the land lots, on changes in the legislation of Ukraine.
The law of Ukraine About modification of some acts of Ukraine from 03.06.2008 of No. 309-Vivneseny of change, except other, in article 124 of the Land code of Ukraine, Art. 16 of the Law of Ukraine About a ground lease, concerning buying of rent the land lots being in the state or municipal property it is exclusive at auctions.
The specified norm doesn’t extend on the land lots on which the objects of fast estate being in a property of citizens and legal mistake where doesn’t have actions (the part, shares), belonging to the state are located; to buying a ground lease under objects of social appointment, for construction of social and affordable housing; in case of use of sites for mining and special water use according to the received permissions (licenses); uses by the religious organizations (under cult structures), legalized in Ukraine.
Carrying out auctions on the land lots which (or constructions on which) rent the budgetary establishments, museums, the enterprises and public organizations in the sphere of culture and arts (including national creative associations and their members under creative workshops) isn’t allowed.
The part 3 of article 137 of the Land code of Ukraine is reworded as follows, by which the organizer of the ground auction the public authority or local self-government, or state authority of the privatization, authorized to carry out alienation of the land lot intended for sale is defined; or the state performer according to a judgment.
It would be desirable to pay attention that it is entrusted to Cabinet council of Ukraine to determine by the above-stated Law features of registration of the right of rent of the land lot without carrying out auction to citizens and legal entities who addressed with the statement (petition) for transfer to rent from lands of the state or municipal property if as of January 1, 2008 or the place of self-government was made by appropriate body of the executive authority the decision on coordination of the location of such object or permission to development of the project of branch is given out.
The specified law came into force from the date of its publication (on June 4, 2008) and is applied from the date of loss of action of the relevant provisions of the section IIZakona About the government budget for 2008 and about entering into some acts of Ukraine. That is actually sale of the right of rent on the competitive beginnings is obligatory since January 1, 2008.
