All of us know, how difficult sometimes happens to the person who has reached a retirement age, but for any reasons not managed to provide all necessary documents for pension charge to resolve this situation. Changes in the legislation of Ukraine which will help to find solutions of many difficult questions are offered attention of readers. The ORDER of definition of a salary (income) for pension calculation in case of loss of documents on its charge and payment <b/> Is approved by the resolution of Cabinet council of Ukraine from July 5, 2006 of N 919 1. This Order enters the mechanism of definition of a salary (income) for pension calculation in case of loss of primary documents on charge and payment by the enterprises, establishments, the organizations of a salary (income) on a primary place of employment of the insured person during an insurance experience till July 1, 2000 in connection with elemental disaster, failures, accidents or on other circumstances independent of the insured person. 2. A salary (income) for pension calculation during an insurance experience of the insured person for every month of an insurance experience, since January 1 1998g. is determined by data of the State register of individuals – payers of taxes and other obligatory payments. 3. One period prior to January 1, 1998. and in case of absence of the individuals given in the State register – payers of taxes and other obligatory payments the salary (income) of the insured person for every month of an insurance experience which is considered at pension calculation, is defined: 1) in the presence of the enterprise, establishment, the organization where the person worked, or their assignee – proceeding from the size of an average salary by the corresponding profession (position) at such enterprise, in establishment, the organization which developed in every month of work for which documents on charge and payment of a salary (income) are lost. At absence at the enterprise, in establishment, the organization or in their assignee of the corresponding profession (position) the salary is determined proceeding from the size of an average salary by a similar profession (position) at such enterprise, in establishment, the organization or at their assignee. The certificate of an average salary by the profession (position) corresponding or similar to it is provided by the enterprise, establishment, the organization where works the person (worked), or their assignee; 2) in case the enterprise, establishment, the organization are liquidated, and documents in body of the highest level or to archival establishments isn’t transferred – proceeding from a tariff rate (an official salary) by the corresponding or similar profession (position) in the relevant branch (system), for the calendar year previous year with which is appointed the pension, or proceeding from minimum guaranteed specified tariff rate (an official salary), provided by the industry agreement (is transferred). Thus the factor of a wage payment (income) of the insured person is defined proceeding from the size of an average salary of the workers occupied in branches of economy of Ukraine, in a month for which the salary pays off, calendar year previous the pension (is transferred) to year from which it is appointed. The certificate of a salary proceeding from a monthly tariff rate (an official salary) by the corresponding or similar profession (position) stands out local body concerning work and social protection of the population, and in case of absence in such body of the specified sheets – Ministry of Labor. At will of the person in the cases provided in this point, the factor of a salary (income) for every month of the period of work is defined proceeding from minimum wage for the corresponding period. 4. Absence at the enterprise, in establishment, the organization or at their assignee of documents on charge and payment of a salary (income), and also time and the reasons which led to loss of such documents, proves to be true the reference of the employer, the assignee or the relevant archival institution. The cabinet council of Ukraine also made changes to the Order of confirmation of the available seniority for purpose of pensions in the absence of the service record or the corresponding records in it. About it it is told in the resolution from July 5, 2006 of N 920. In particular point 20 is added with the paragraph of such contents: In case of absence of the assignee confirmation of the periods of work which are set off in the seniority for purpose of pension on favorable terms or for long service, established for separate categories of workers, is carried out in an order defined by the Pension fund of Ukraine in coordination with Ministry of Labor and the Ministry of Finance.
